The YogiFi Sens AI Band ("Band") is a hardware device sold and supported by the Company. Any service availed by users (hereinafter referred to as "you", "your" or "User") through the Platform or in connection with the Band is conditioned upon your acceptance of the Terms of Service available on the Platform and this Privacy Policy ("Privacy Policy").

1. Introduction and Applicability

1.1 We are strongly committed to respecting your online and device privacy and recognise the need for appropriate protection and management of any personal information collected and/or collated by us in connection with your use of the Sens AI Band and the Platform.

1.2 The purpose of this Privacy Policy is to ensure there is a clear and intact charter to collect, use and protect any personal and/or sensitive data collected by us. This Policy defines our procedure for collection, usage, processing, disclosure and protection of any information obtained from you through the Platform and through the Sens AI Band's biometric sensors.

1.3 This Privacy Policy applies specifically to data collected via the YogiFi Sens AI Band — a screenless wearable biometric sensor device — and through the YogiFi app and website. It should be read together with our Terms of Service.

2. Disclaimer

2.1 Please be advised that any Information (as defined herein below) procured by us shall be:

a. processed fairly and lawfully for rendering the Services (as defined in the Terms of Service);

b. obtained only for specified and lawful purposes and not used in any manner which is against the law or policy in force ("Applicable Law");

c. adequate, relevant and not excessive in relation to the purpose for which it is required;

d. able to be reviewed by the User from time to time and updated if the need arises; and

e. not kept longer than is required for the purpose for which it is required or as required by Applicable Law.

2.2 WE SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE SUSTAINED BY REASON OF ANY DISCLOSURE (INADVERTENT OR OTHERWISE) OF ANY DATA, IF THE SAME IS EITHER (A) REQUIRED FOR SHARING YOUR INFORMATION FOR LEGITIMATE PURPOSES; OR (B) WAS AFFECTED THROUGH NO FAULT, ACT, OR OMISSION OF THE COMPANY.

2.3 BY USING THE SERVICES AND/OR THE BAND, YOU EXPLICITLY ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, THE COLLECTION, USE AND TRANSFER OF THE DATA IN THE MANNER DESCRIBED HEREIN.

2.4 PLEASE READ THIS PRIVACY POLICY CAREFULLY AS IT AFFECTS YOUR RIGHTS AND LIABILITIES UNDER LAW.

3. Your Consent

3.1 By providing the Information (as enumerated below), you provide your consent and authorise us to collect, use or disclose such Information for business and research purposes and as stated in this Privacy Policy, the Terms of Service, and as permitted or required by Applicable Law. You understand and hereby consent that this Information may be transferred to third-party service providers for the purpose of rendering Services through the Platform, including payment processing, order fulfilment, customer services, data analysis, information technology services, and such other services which enable us to provide Services through the Platform.

3.2 This Privacy Policy shall be enforceable against you in the same manner as any other written agreement. By visiting or accessing the Platform, pairing or using the Sens AI Band, or voluntarily providing us with Information (including Personal Data), you are consenting to our use of that Information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, you may refuse or withdraw your consent at any time, or alternatively choose not to provide us with any Personal Information. Under such circumstances, we may be unable to render Services or provide full functionality of the Band.

4. Types of Information Collected by Us

The Sens AI Band is a biometric wearable sensor device. In addition to standard platform information, we collect health and biometric data generated continuously by the Band's sensors. The following categories of Information are collected:

4.1 Personal Data  means and includes any Information that relates to a natural person through which an individual is identified, such as name, contact details, email address, gender, date of birth, age, or any other relevant material provided by a User — including information gathered through availing Services and communications with instructors or Company representatives. It also covers information of a User's care person details (name, age, gender, mobile number, relationship with the User).

4.2 Biometric and Health Data  means and includes continuous and periodic health and physiological data generated by the Sens AI Band's onboard sensors, transmitted to and processed within the YogiFi app. This includes:

•  Heart Rate: continuous optical PPG-based heart rate monitoring;

•  Heart Rate Variability (HRV): real-time and trend-based HRV measurement used to assess recovery, stress, and readiness;

•  Blood Oxygen Saturation (SpO₂): spot-check and continuous blood oxygen monitoring;

•  Blood Pressure Trends: non-invasive blood pressure trend tracking (not a clinical diagnostic);

•  Sleep Data: sleep duration, sleep staging (light, deep, REM, and awake stages), and sleep quality score;

•  Stress Index: derived from HRV and autonomic nervous system activity patterns;

•  Skin Temperature: continuous skin temperature monitoring;

•  VO₂ Max Estimate: estimated maximum oxygen uptake (available on Elite tier);

•  Respiratory Rate: breathing rate derived from movement and PPG data;

•  Activity and Movement Data: step count, distance, calories burned, and general activity levels captured by the 3-axis accelerometer;

•  Mood Score: a biometric-derived score reflecting physiological indicators of mood and wellbeing (Elite tier).

This Biometric and Health Data is used to generate personalised wellness recommendations through the YogiFi app, including yoga, breathwork, and meditation program prescriptions calibrated to your physiological state.

4.3 Purchase Data  means and includes order history and information relating to your purchase of the Band and/or subscription to the Services.

4.4 Technical Information  means and includes any Information gathered through various technologies that may employ cookies, web beacons, or similar technologies to automatically record certain information from your device through which you use the Platform. This technical information may include your Internet Protocol (IP) address, device or browser type, Internet Service Provider (ISP), referring or exit pages, clickstream data, and operating system. This data includes usage information and user statistics.

4.5 Locational Information  means and includes information obtained through GPS or other means, such as the geographical location of the User, where permitted and relevant to the delivery of Services.

4.6 Non-Personal Information  

a. "Information through use of our service" means and includes information shared with us to avail our Services, including but not limited to chats with instructors and communications with Company representatives.

b. "Non-Personal Information" means and includes any information that does not reveal your specific identity, such as browser information, surveys conducted by us, information collected through Cookies (as defined below), pixel tags and other technologies, and demographic information. As is true with most websites and apps, our Company gathers some information automatically when you visit the Platform or use the YogiFi app.

The above-mentioned categories shall be collectively referred to as "Information".

Important: Biometric and Health Data collected by the Sens AI Band is used solely to provide and improve wellness services within the YogiFi ecosystem. This data will not be used for advertising, marketing, or sold to third parties. Health data is not used to make automated decisions about individual Users outside the scope of the wellness recommendations described in this Policy.


5. Purpose of Collection and Usage of Information

5.1 The data collected by us shall be used for the following purposes, including but not limited to:

a. to render Services (as defined in the Terms of Service), including generating personalised yoga, breathwork, and meditation program recommendations based on your biometric data;

b. to operate, maintain, and improve the Platform and the Band's performance;

c. to evaluate the quality and competence of our personnel and content;

d. to resolve any complaints and ensure you receive the highest quality of Services;

e. to notify you about changes to our Platform, the Band's firmware, or the YogiFi app;

f. to allow you to participate in interactive features of the Platform when you choose to do so;

g. to provide analysis and insights that allow us to improve the Platform and Services;

h. to monitor usage of the Platform;

i. to detect, prevent and address technical issues with the Band, app, or Platform; and

j. to generate your personalised Daily Readiness Score, recovery recommendations, and AI wellness reports.

5.2 Business or Research Purposes: Information — except Personal Data — may be used for business or research purposes, including improving and customising the Platform and enhancing the Band's biometric capabilities. We may archive this information to use it for future communications, product updates, and/or surveys.

5.3 Aggregating Information / Anonymised Data: We may aggregate Information and analyse it to improve the Services we offer. This may include average readiness scores, program engagement rates, general usage statistics, and population-level wellness trends. In doing so, we will not make disclosures of any Personal Data as defined above.


6. Disclosure and Sharing of Information

6.1 We do not rent, sell, or disclose any Information that we collect from you to third parties, except in order to provide you with the Services in accordance with this Privacy Policy and as required by law. We may share your Information in the following circumstances:

a. With third-party service providers and vendors who assist us in delivering the Services;

b. When compelled by law, including to comply with legal process; respond to requests from public or government authorities; protect our operations, rights, safety, or property; or to prevent or investigate wrongdoing in connection with the Platform;

c. If a user withdraws consent, we will promptly cease all collection, use, or disclosure of their data and take steps to protect it from unauthorised access;

d. Merger or Acquisition: We may share Information upon merger or acquisition with another company;

e. With service providers on a need-to-know basis, subject to confidentiality obligations, for services including but not limited to website hosting, data analysis, IT services, and auditing;

f. With employees or agents of the Company on a strict need-to-know basis under confidentiality obligations;

g. Health and biometric data collected via the Band is used solely to provide health, activity, or wellness services in connection with the YogiFi app. This data will not be used for marketing, advertising, or use-based data mining, including by third parties.

6.2 Except as described in Clause 6.1, Company may share Information only if you explicitly authorise us to do so.


7. Transfer of Information

7.1 We may share your Information, as well as information from tools like cookies, log files, device identifiers, and Biometric and Health Data, with third-party organisations that help us provide the Service to you ("Service Providers"). Service Providers will be given access to your information only as reasonably necessary to provide the Service, under reasonable confidentiality terms.

7.2 Your information may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where data protection laws may differ from those in your jurisdiction.

7.3 If you are located outside India or the United States and choose to provide information to us, please note that we may transfer your data to India and/or the United States to process it.

7.4 We may remove parts of data that can identify you and share anonymised data with other parties. We may also combine your information with other data in a way that is no longer associated with you and share that aggregated information.

7.5 Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

7.6 We will take all steps reasonably necessary to ensure your data is treated securely and in accordance with this Privacy Policy. No transfer of your data will take place to an organisation or country unless adequate controls are in place, including the security of your data and other personal information.


8. Your Rights

You retain several rights in relation to your Personal Information as provided under Applicable Law. These include the rights to:

•  access, confirm, and review Personal Information and Biometric and Health Data you have provided;

•  correct Personal Information or Biometric and Health Data that may be inaccurate or irrelevant;

•  request deletion and erasure of your Personal Information from the Platform;

•  receive Personal Information we hold about you in a portable format;

•  object to or restrict any form of processing you may not be comfortable with;

•  withdraw consent for data collection at any time, as described in Clause 3.3.

9. Third-Party Applications

9.1 You may use our Services in conjunction with third-party mobile applications not operated by us. We strongly advise you to review the privacy policy of every mobile application you use.

9.2 We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party mobile applications or services.


10. Children's Privacy

The Sens AI Band and Platform are not intended for use by persons under the age of 18. If we become aware that we have collected Personal Data or Biometric and Health Data from a child without verification of parental consent, we will take steps to remove that information from our servers promptly.


11. Control Over Collection or Use of Information

If you have any reservations or concerns regarding the access, collection, storage, or any other use of the Information you have provided to us — including Biometric and Health Data collected by the Band — you may withdraw your consent in the manner set out in Clause 3.3 above. Please note that withdrawing consent may limit your ability to use certain features of the Band and the YogiFi app.

12. Retention of Information

All Information provided by you shall be retained in locations outside the direct control of the Company (for instance, on servers or databases co-located with hosting providers). We will delete Information based on a request received from you within a reasonable period and latest within 90 (ninety) days of receiving a deletion request. However, we may retain such portion of Information and for such periods as may be required under Applicable Law.

Notwithstanding anything contained herein, the Company may retain data after account deletion for reasons including but not limited to: (a) if there is an unresolved issue relating to your account or an unresolved claim or dispute; (b) if required by Applicable Law; (c) in aggregated and/or anonymised form; or (d) if necessary for legitimate business interests such as fraud prevention and enhancing user safety and security.

Biometric and Health Data synced from the Band to the YogiFi app is subject to the same retention schedule and deletion rights as all other Personal Data.

13. Cookies and Other Tracking Technologies

13.1 Our Platform may utilise "cookies" and other Technical Information. Cookies are small text files used to collect information about Platform activity. Technical Information helps us analyse web traffic and customise the Platform to your preferences. Cookies do not give us access to your device.

13.2 Our use of Cookies and Technical Information allows us to improve the Platform and your experience of our Services. You may deny access to the installation of Cookies by modifying the settings on your web browser or device; however, this may prevent you from taking full advantage of the Platform.

13.3 We may also analyse Technical Information that does not contain Personal Information for trends and statistics.

14. Third-Party Services

We may use your Information to send you promotional information about third parties which we think you may find interesting, if you have told us you wish this to happen. We shall not be responsible for any disclosure of Information due to unauthorised third-party access or other acts of third parties or acts or omissions beyond our reasonable control. You agree that you will not hold us responsible for any breach of security unless such breach has been caused as a direct result of our negligence or wilful default.

15. Data Security

We use physical, managerial, technical, and operational safeguards in line with industry standards and established best practices to protect the Information we collect, including Biometric and Health Data transmitted by the Sens AI Band. We use secure servers and review our Information collection, storage, and processing practices — including physical security measures — to guard against unauthorised access.

Biometric and Health Data is transmitted from the Band to the YogiFi app via Bluetooth 5.4 and is processed using encrypted protocols. We take appropriate steps to ensure the security of this data at rest and in transit.

However, no security system is impenetrable. We cannot guarantee the security of our databases, nor guarantee that information you supply will not be intercepted while being transmitted over the internet. You accept the inherent security implications of data transmission over the internet. Your use of the Platform will be at your own risk. If you have concerns, please contact us using the details in Section 17.

16. Changes and Updates to This Policy

We may modify or revise this Privacy Policy from time to time and will notify you of any changes by posting the revised Privacy Policy on the Platform with an updated revision date. We endeavour to review and update the Privacy Policy regularly — especially whenever a significant update is made to the Band's firmware, the YogiFi app, or our data collection practices. You must periodically review the Privacy Policy for the latest information on our privacy practices. If you continue to use the Platform, the Band, or our Services after any update, your continued use constitutes acceptance of the updated Privacy Policy.

17.1 If you have any discrepancy, grievance, or concern regarding your Information or Biometric and Health Data shared with or collected by the Company, or in relation to this Privacy Policy, please reach out to our support team using any of the following channels:

17.2 We assure you that we shall ensure implementation of this Privacy Policy and make it available to individuals at all times. We will put our best efforts to redress grievances expeditiously and within one (1) month from the date of receipt of the grievance.

17.3 For any Band-specific concerns — including questions about biometric data collected, stored, or processed by the Sens AI Band — please specifically reference "Band Data Concern" in your subject line when contacting support@yogifismart.com so we can direct your query to the appropriate team.

18. Behavioural Analytics and User Journey Tracking

18.1 The Company uses third-party behavioural analytics tools, including Microsoft Clarity (provided by Microsoft Corporation) and other analytics platforms (collectively, "Analytics Tools"), to collect non-personally identifiable information about how Users interact with and navigate through the Platform.

18.2 The Analytics Tools may collect the following categories of information ("Usage Data"):

•  screens visited and the sequence in which they are accessed;

•  tap, scroll, and navigation interactions within the Platform;

•  session duration and drop-off points within the user journey;

•  device type, operating system, app version, and app performance data; and

•  error reporting and crash diagnostics.

18.3 The purpose of collecting such Usage Data is strictly limited to understanding User behaviour and navigation patterns within the Platform, identifying friction points in the user journey, and improving the overall functionality, design, and experience of the Platform and its Services.

18.4 Usage Data collected through Analytics Tools does not personally identify you and is processed in aggregated and anonymised form. The Company does not use Usage Data to make decisions about individual Users.

18.5 By accessing or using the Platform, you consent to the collection and processing of Usage Data as described in this section, in accordance with this Privacy Policy. Microsoft may also process such data pursuant to its own privacy policy, available at microsoft.com/en-us/clarity.

19. Miscellaneous

THE INVALIDITY OR UNENFORCEABILITY OF ANY PART OF THIS PRIVACY POLICY SHALL NOT PREJUDICE OR AFFECT THE VALIDITY OR ENFORCEABILITY OF THE REMAINDER OF THIS PRIVACY POLICY. THIS PRIVACY POLICY DOES NOT APPLY TO ANY INFORMATION OTHER THAN THE INFORMATION COLLECTED BY US THROUGH THE PLATFORM OR THE SENS AI BAND. THIS PRIVACY POLICY SHALL BE INAPPLICABLE TO ANY UNSOLICITED INFORMATION YOU PROVIDE US THROUGH THE PLATFORM OR THROUGH ANY OTHER MEANS. ALL UNSOLICITED INFORMATION SHALL BE DEEMED TO BE NON-CONFIDENTIAL AND WE SHALL BE FREE TO USE AND/OR DISCLOSE SUCH UNSOLICITED INFORMATION WITHOUT ANY LIMITATIONS. THE RIGHTS AND REMEDIES AVAILABLE UNDER THIS POLICY MAY BE EXERCISED AS OFTEN AS NECESSARY AND ARE CUMULATIVE AND NOT EXCLUSIVE OF RIGHTS OR REMEDIES PROVIDED BY LAW. RIGHTS UNDER THIS POLICY MAY BE WAIVED ONLY IN WRITING. DELAY IN EXERCISING OR NON-EXERCISE OF ANY SUCH RIGHT OR REMEDY DOES NOT CONSTITUTE A WAIVER OF THAT RIGHT OR REMEDY, OR ANY OTHER RIGHT OR REMEDY.

20. Governing Laws and Jurisdiction

This Privacy Policy, our Services, and the use of the Sens AI Band are governed by the laws of India. Any disputes connected to this Privacy Policy shall be resolved by binding arbitration as mentioned in the Terms of Service.

BY USING OR VISITING THIS PLATFORM, PAIRING OR USING THE SENS AI BAND, OR AVAILING ANY OF OUR SERVICES, YOU SIGNIFY YOUR AGREEMENT TO THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO ANY OF THESE TERMS, PLEASE DO NOT USE THIS PLATFORM, THE BAND, OR OUR SERVICES.
